These Terms of Service ("Terms") govern your use of the THEPLOYERS website at THEPLOYERS.in and all services provided by THEPLOYERS, operated by [Your Legal Name / Business Name], Guwahati, Assam, India ("THEPLOYERS", "we", "us", "our"). By accessing our website or purchasing any service, you ("Client", "you") agree to be bound by these Terms.

2.1 What We Provide

THEPLOYERS provides custom digital development services including but not limited to: Telegram bot development, web development, REST API development, cloud deployment, and related automation systems. Specific deliverables for each purchase are defined by the plan selected and confirmed via Telegram/WhatsApp communication post-payment.

2.2 Service Scope

Each plan has a defined scope communicated on our pricing page and confirmed during the requirements discussion. Requests outside the agreed scope may be accommodated as paid additions at our discretion. We reserve the right to decline projects that conflict with our values, legal obligations, or technical capabilities.

2.3 Timelines

Delivery timelines are estimates, not guarantees, unless explicitly agreed in writing. Timelines may be affected by your responsiveness in providing requirements, assets, or approvals. We will communicate any significant delays proactively.

2.4 Support Period

Post-delivery support is available for the duration specified in your plan (7 days for Starter, 30 days for Pro). Support covers bug fixes and clarifications related to the delivered work. It does not cover new features, hosting issues outside our control, or third-party service outages (e.g. Telegram API downtime).

3. Payment

All prices are displayed in Indian Rupees (INR) inclusive of applicable GST (18%). Payments are processed via Cashfree Payments. By proceeding to checkout, you agree to Cashfree's Terms of Service.

Full payment is required before work begins. For custom projects (Custom Build plan), payment terms will be discussed and agreed separately before work starts.

All refunds are governed by our Refund & Cancellation Policy.

4. Intellectual Property & Ownership

4.1 Your Ownership on Delivery

Upon full payment and final delivery, you receive full ownership of the source code, assets, and deliverables produced for your project. You may use, modify, distribute, or resell the delivered work without attribution to THEPLOYERS, unless otherwise agreed.

4.2 Third-Party Components

Our deliverables may include open-source libraries, frameworks, or components governed by their own licences (e.g. MIT, Apache 2.0). These are not transferred with the project — they remain under their respective licences. We will disclose significant third-party components used in your project.

4.3 Our Pre-Existing IP

We may use internal boilerplate code, utilities, or template modules in your project. You receive a non-exclusive, perpetual licence to use these as part of your delivered product, but ownership of these components remains with THEPLOYERS.

4.4 Portfolio Rights

We reserve the right to include your project in our portfolio as a reference to the type of work we do, unless you request otherwise or we have signed an NDA. We will not share source code, proprietary business logic, or confidential information in any portfolio reference.

5. Acceptable Use

You agree not to use THEPLOYERS services to build or operate systems that:

If we discover mid-project that the intended use violates these terms, we reserve the right to immediately cease work and retain any payment already received. If the violation is discovered after delivery, we reserve the right to disable any hosted components we control.

6. Confidentiality

We treat your project requirements, business information, and technical details as confidential by default. We do not share this information with third parties except as required to deliver the service (e.g. sharing credentials with a cloud provider to deploy your app).

If you require a formal Non-Disclosure Agreement (NDA), request it before work begins and we will sign one. The NDA supersedes this clause.

7. Limitation of Liability

To the maximum extent permitted by Indian law, THEPLOYERS's total liability to you for any claim arising out of or relating to these Terms or the services shall not exceed the total amount you paid for the specific service giving rise to the claim.

10. Governing Law & Dispute Resolution

These Terms are governed by the laws of India. Any disputes shall be first attempted to be resolved amicably via direct communication on Telegram or email within 30 days.

If resolution is not reached, disputes shall be submitted to the exclusive jurisdiction of the courts in Guwahati, Assam, India. You waive any right to bring a class action against THEPLOYERS.

11. Changes to These Terms

We may update these Terms at any time. The updated version will be posted on this page with a new "Last Updated" date. Your continued use of our services after changes constitutes acceptance. For ongoing projects, changes to Terms do not retroactively alter the agreed scope or pricing for that project.
